Victorian Prostitution Legislation Amendment - A step in the right direction

As of the 1st of June 2016, a new amendment to the Victorian Prostitution legislation.

The focus that we are involved in is internet advertising for escorts in Victoria.

There is a heavy base of escorts working in Melbourne both privately, for an agency or in brothels.

The previous legislation restricted advertising to only allow head and shoulder images. This is quite difficult to capture a market if an escort chose to blur his or her face. It left nothing but a blurry image on screen. To aide a better visual, escorts, brothels, agencies and directories had to create interstate galleries to allow the Victorian escorts to display full body shots.

This new legislation is a step in the right direction and it’s making it easier for all advertisers to showcase and market themselves.

Part 3 Advertising Controls - Section (5)

An advertisement for a business carried on by a sex work service provider that is published on the Internet may contain a photographic or other pictorial representation of a person which is not restricted to the head and shoulders, provided that the advertisement does not contain a photographic or other pictorial representation of :

(a) the bare sexual organs, buttocks or anus of a person, or frontal nudity of the genital region; or

(b) bare breasts; or

(c) a sexual act or simulated sexual act; or

(d) a person under the age of 18 years.

This new legislation is effective 1st June 2016.
